Welcome to Rockversity and its affiliated brands, including Level One, Big Birdie Golf, Pause Journals, and other Rockversity creative ventures (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of our websites, online stores, and services related to custom apparel, merchandise, design, and promotional products.

By accessing our website or placing an order, you agree to be bound by these Terms. Please read them carefully before using our services.

1. General Use

Our website and services are intended for individuals and businesses seeking custom apparel, promotional items, and branding solutions. You agree to use our site only for lawful purposes and not to interfere with its operation, security, or functionality.

2. Quotes, Orders, and Approvals

  • Quotes: Estimates are valid for 15 days unless otherwise stated. Pricing may change if materials, specifications, or quantities change.
  • Orders: Production begins only after payment (or deposit) and written approval of all digital proofs or artwork.
  • Approvals: You are responsible for reviewing all proofs carefully. Once approved, designs move into production and cannot be modified.
  • Turnaround Times: Standard production timelines begin after proof approval and payment and may vary based on project complexity, material availability, or seasonal volume.

3. Custom Artwork and Intellectual Property

  • All designs, logos, or files provided by you are assumed to be your property or used with proper authorization. You agree to indemnify Rockversity against any claims of copyright or trademark infringement.
  • Artwork, mockups, and design files created by Rockversity remain our intellectual property and may not be reused, modified, or reproduced without written permission.
  • We reserve the right to photograph and display finished products for marketing or portfolio purposes unless otherwise requested in writing.

4. Payment and Billing

  • Full payment (or a deposit, if approved) is required before production.
  • Accepted payment methods include major credit cards, ACH transfers, and other listed options on our checkout page.
  • Unpaid balances may result in production delays, order cancellation, or collection actions.
  • Late Payment Penalty: Unpaid balances not received by the due date will accrue a 10% late payment penalty for each 30-day period beyond the payment due date until paid in full. Customers are responsible for any collection costs, attorney’s fees, or administrative expenses incurred in recovering unpaid amounts.
  • Sales tax applies where required by law.

5. Cancellations, Rush Orders, and Changes

  • Once production has begun, orders cannot be canceled or changed.
  • Cancellations prior to production may be subject to design, setup, or restocking fees.
  • Rush Orders: Orders requiring expedited production or delivery are subject to additional rush fees. These fees will vary based on production capacity, material availability, and requested turnaround time. Rush orders are non-cancelable, non-refundable, and not guaranteed to meet delivery dates affected by factors outside Rockversity’s control (including carrier delays or material shortages).

6. Returns, Exchanges, and Defects

Because our items are custom-made, all sales are final. However, we stand by our quality:

  • If you receive defective or incorrect items due to our error, contact us within 7 business days of delivery for resolution.
  • Approved replacements or credits will be issued at our discretion after inspection.
  • We are not responsible for sizing errors, color variations (within industry tolerances), or issues arising from customer-provided artwork or garments.

7. Color Matching and Materials

Due to variations in monitors, inks, threads, and fabrics, exact color matches cannot be guaranteed. Pantone color matching is available upon request and may incur additional fees. Material substitutions of equal or higher quality may occur if supply shortages arise.

8. Shipping and Delivery

  • We ship via major carriers and provide tracking information upon dispatch.
  • Shipping times are estimates, not guarantees.
  • Once shipped, Rockversity is not responsible for carrier delays, weather disruptions, or lost/stolen packages.
  • Local pickup options are available where applicable.

9. Limitation of Liability

To the fullest extent permitted by law:

  • Rockversity and its affiliates shall not be liable for indirect, incidental, or consequential damages, including lost profits or opportunity costs.
  • Our total liability for any claim shall not exceed the total amount paid for the specific order in question.

10. Privacy and Data Protection

We value your privacy. Any personal information collected through our website or checkout process is handled in accordance with our Privacy Policy and will never be sold to third parties.

11. Trademarks and Branding

All Rockversity names, logos, and associated sub-brand marks (including Level One, Big Birdie Golf, and Pause Journals) are trademarks of Rockversity. Unauthorized use, reproduction, or imitation is strictly prohibited.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Alameda County, California.

13. Changes to Terms

We may update these Terms from time to time. Updates will be posted on this page with the revised effective date. Continued use of our site or services signifies your acceptance of any changes.
